NOTIFICATION OF INTENT TO PUBLISH PHOTOGRAPHIC IMAGES
Conditions of Publication of National Public Broadcasting Archives Materials:
1. All requests will be considered on a case-by-case basis.
2. It is the policy of the National Public Broadcasting Archives to assess a use fee for the commercial publication of each item from its collection. The Archives reserves the right to judge whether a proposed publication is commercial, based on the nature of the publication, the publisher, and the intended circulation. The Archives also reserves the right to assess a use fee if a scholarly publication consists extensively or exclusively of materials from the Archives' collection.
3. Use fees cover non-exclusive, one time use of a single item unless otherwise indicated and are to be paid in advance of publication. Use fees are assessed in addition to any duplication costs. Rights are not granted in perpetuity.
4. Publication can take place only under the provisions of the fair use doctrine in the U. S. Copyright Law (as amended) or by obtaining permission of the copyright holder, which in some instances may the the National Public Broadcasting Archives or the University of Maryland.
5. The National Public Broadcasting Archives must be assured that the proposed publication will result in a suitable presentation of the original. Superimposition of text, cropping, bleeding, the addition of color, or other alterations are not allowed.
6. All publication of National Public Broadcasting Archives materials must bear the credit line:
7. The Library requires that a complete copy of any publication (in any medium) that makes use of its materials be give to the Library for its collections.
8. No unauthorized copies may be made of the materials provided.

THE APPLICANT WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS THE National Public Broadcasting Archives AND THE UNIVERSITY OF MARYLAND SYSTEM, ITS BOARD OF REGENTS, THE UNIVERSITY OF MARYLAND, ITS OFFICERS, EMPLOYEES AND AGENTS AGAINST ALL CLAIMS, DEMANDS, COSTS, AND EXPENSES INCLUDING ATTORNEYS' FEES INCURRED BY COPYRIGHT INFRINGEMENT OR ANY OTHER LEGAL OR REGULATORY COURSE OF ACTION ARISING FROM THE USE OF National Public Broadcasting Archives MATERIALS.
